Support Chuck Turner!  The Struggle Continues!

In the most recent racist and reactionary link in the vicious chain of the politically motivated frame up of Boston African American City Councilor and community leader Chuck Turner, Federal Judge Woodlock denied Chuck's motion for a stay of execution of sentence pending the appeal of his conviction, effectively appointing himself judge jury and executioner, thus proving that Capitalist judges are always more class conscious than constitutionally minded.

Adding cruel and racist insult to injury, he has been sentenced to serve his 3 years at the United States Penitentiary at Hazelton in remote Bruceton Hills West Virginia. We must not allow this heroic and courageous brother and fighter for justice to be isolated and his voice be silenced. Below you will find Chuck's "See You Soon! Continue the Struggle" letter to supporters which appeared in the Boston Black Community paper, the Boston Banner. As Chuck has said "A Luta Continua - The Struggle Continues!

Please continue to support Chuck while he is incarcerated. Write to him at the Hazelton Minimum Security Camp P.O. 2000, Bruceton Mills, West Virginia 26525.  Stay tuned for more information on how to help. Chuck has shown by his brilliant example how to fight back against the power of the state! "Be part of the Chain of Change!"

Words from Chuck: "See You Soon!

It seems inconceivable that after 46 years of service to my people and my community, I am about to spend three years in a federal lockup. However, as the song says, “Keep your Eyes on the Prize”. Don’t let the defeats in the struggle for justice distract. Given the 400 year experience of our ancestors, I have no right to complain despite the injustice of it all.

Terri and I thank you for your wonderful support. It reminded us of what community really means. How can you help?

The most important assistance is to stand up and fight back whenever you see injustice. You and I know that US Attorney Sullivan’s objective was to break our spirit. They now know they can’t break mine. Show them the can’t break yours. Be part of the unending the Chain of Change. Don’t complain. Fight Back.

Former US Atty. Sullivan has failed. His purpose was to silence me. However, he is learning that while his system can put my body in jail, my spirit and voice remain free. You can access my writings at SupportChuckTurner.com  and BlackCommentator.com.

A Luta Continua—The Struggle Continues!

Chuck

PS Chuck thanks you for attending last night’s (3/24/11) Forum, Crimes Under Color of Law, at N.U. Law School. Although Chuck won’t be able to attend, he encourages everyone to participate in the planning session to identify the next steps to be taken by our community and the legal community to investigate the criminal collusion between the FBI and the MA US Atty.’s office.

Starting today, Chuck will be incarcerated at the Hazelton Minimum Security Camp P.O. 2000, Bruceton Mills, West Virginia 26525.  Those wishing to communicate, can write to Chuck at the above address."

 3.    [3/24] Chuck’s Last Appearance Before Incarceration

Turner to Address Crimes of US Attorney’s Office

Framing the Innocent: Crimes Under Color of Law at the Massachusetts US Attorney’s Office

          Thursday, March 24, 7:00 P.M.
Northeastern University School of Law, 240 Dockser Hall (65 Forsyth St. Boston)

Speakers:

Chuck Turner: five-term Boston City Councilor representing Roxbury and Dorchester, and a lifetime activist for social justice, recently targeted by the FBI and the Massachusetts us attorney.

Bob Boyle: attorney representing many activists and political prisoners targeted by the FBI’s infamous counter-intelligence program (cointelpro).

Laila Murad: organizer from the Tarek Mehanna support committee Michael Avery: professor of law, Suffolk Law School, won a landmark civil suit against the Boston FBI on behalf of four men wrongfully convicted of murder.

BOSTON – On Thursday, March 24th, at 7 p.m., the night before he will begin serving a federal prison sentence, former City Councilor Chuck Turner will participate in a forum entitled “Framing the Innocent: Crimes Under Color of Law at the Massachusetts US Attorney’s Office.”

The event is being organized to draw attention to serious misconduct within the office of the US Attorney in Boston. Other speakers will include civil rights Attorney Bob Boyle, Laila Murad, an organizer for the Tarek Mehanna Support Committee, and law professor Michael Avery.

The event will take place in Room 240 of Northeastern University’s Dockser Hall (65 Forsyth St., Boston).

Turner and the other organizers of the event believe that prosecutorial abuse within the US Attorney’s office hasn’t been given the scrutiny it deserves. Massachusetts Supreme Court Justice Mark L. Wolf, who has been a leader in exposing and censuring the US Attorney’s office for its criminal misconduct, is on record stating that there is a “dismal history of intentional and inadvertent violations” on the part of the US Attorney’s office.

The forum is designed to educate the public about the ways in which the abuses by the US Attorney incriminate innocent people and jeopardize the prospects for justice.

Chuck Turners Last Public Appearance

***

Over the past few years, an atrocious history of government misconduct at the Massachusetts US Attorney's office has emerged in the court record, but few people have heard about it.

In the case Ferrara v. US, the court found that US Assistant Attorney Jeffrey Auerhahn worked with an FBI agent to coerce a witness into maintaining false testimony, withheld evidence of the witness's recantation from defense counsel, and perjured himself in court. Other members of the office have:

        --Withheld information about misconduct by FBI agents;

--Consistently and deliberately withheld evidence of the innocence of defendants from defense counsel and from the court.

The head of the Massachusetts US Attorney's office has shielded assistants and acted to cover-up government misconduct. Auerhahn was given responsibility to prosecute "terrorism" cases, where he continues to handle government informants and "cooperating witnesses."

The Massachusetts US Attorney has also demonstrated a clear set of political priorities: contempt for basic civil liberties and due process rights; an anti-immigrant agenda; selective prosecution of black political leaders; and the prosecution of an overwhelming number of indigent defendants and people of color.

Although the US Attorney's office has extraordinary power, people who are concerned about government abuses have paid comparatively little attention to its role within the criminal justice system.

Come participate in a public discussion about the Massachusetts US Attorney's Office and what we can do to hold it accountable to our concerns.

The Honorable Sumner Z. Kaplan

It is with great sadness that JALSA shares the news that Sumner Z. Kaplan, one of JALSA's founders and one of our greatest fans, passed away Tuesday at the age of 92.  As most of you know, Sumner had tremendous energy and actively participated in everything we did until just a few months ago when he became ill.  We hoped his health would return, but unfortunately, that was not to be.   We have lost a tremendous friend.

Sumner was the beloved husband of 66 years to Eleanor ( Ellie) Kaplan; devoted father of Ruth Kaplan and her husband Toby Kusmer, Marjorie Kaplan and her husband Michael Stanislawski;  dear grandfather of Sarah Rose Kusmer and Anna Kusmer, Ethan, Aaron and Emma Stanislawski .

The funeral will take place on Friday, March 25 at 11 am at Congregation Kehillath Israel, 384 Harvard Street in Brookline.

Shiva will be held at the home of his daughter Ruth Kaplan and Toby Kusmer, 24 Spooner Road, in Chestnut Hill on Friday from the conclusion of the funeral service until 4 pm, and on Saturday night from 8-10 pm with minyan at 8 pm.  Shiva will continue from Sunday-Wednesday from 2-4 pm and 7-9 pm, with minyan at 7 pm.

We extend our deepest sympathies to Sumner's wife, Ellie, and his daughters, Ruth and Marjorie, and to his entire extended family.  As a community we mourn the loss of our dear friend and fierce leader for justice.

JALSA's Commission on Law and Social Action (CLSA) will not meet

on Friday, March 25

so that our members may attend Sumner's funeral service.
